Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) form a binding agreement between MyClaudia Ltd (“MyClaudia”, “we”, “us”, or “our”) and the salon, spa, or business (“you” or “Subscriber”) that registers for or uses the MyClaudia platform at myclaudia.ai. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Service Description

MyClaudia provides an AI-powered receptionist platform designed for salons and spas. The service includes:

  • AI-driven client communication via SMS, email, and chat
  • Automated appointment booking, confirmation, and reminders
  • Client intake, follow-up, and re-engagement messaging
  • A management dashboard for salon owners and staff
  • Reporting and analytics on bookings and client interactions

The service is provided as-is and is subject to change. We will provide reasonable notice of material changes that affect your use of the platform.

3. Eligibility and Account Registration

You must be at least 18 years old and authorised to enter into contracts on behalf of your business to use MyClaudia. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at legal@myclaudia.ai if you suspect unauthorised access.

4. Acceptable Use

You agree to use MyClaudia only for lawful business purposes. You must not:

  • Use the platform to send spam, unsolicited marketing, or illegal communications
  • Violate applicable data protection laws when collecting or processing client data
  • Attempt to reverse-engineer, scrape, or extract the underlying AI models
  • Resell or sublicense access to the platform without written permission
  • Use the service in a way that could damage, disable, or impair our infrastructure
  • Impersonate any person or entity or provide false account information

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice depending on the severity of the breach.

5. Payment Terms

Subscription fees are billed monthly or annually in advance, depending on your selected plan. All payments are processed by Stripe. By providing payment details, you authorise MyClaudia to charge the applicable subscription fee on each billing cycle.

All fees are exclusive of applicable taxes (e.g. GST, VAT), which will be added where required by law. Prices may change with 30 days' written notice. If you do not cancel before the next billing date, you will be charged at the new rate.

Subscription fees are non-refundable except where required by law or at our sole discretion. If we terminate your account for reasons other than your breach of these Terms, we will provide a pro-rated refund for unused prepaid time.

6. Data Ownership

You retain full ownership of your salon's data, including your client records, appointment history, and any content you upload or create within the platform. MyClaudia does not claim ownership of your data. You grant us a limited licence to process your data solely to provide and improve the service as described in our Privacy Policy. Upon cancellation, you may export your data within 90 days before it is permanently deleted.

7. Intellectual Property

The MyClaudia platform, including its software, design, AI models, and branding, is owned by MyClaudia Ltd and protected by intellectual property laws. Nothing in these Terms transfers ownership of MyClaudia's intellectual property to you. You may not copy, modify, or create derivative works from our platform without prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, MyClaudia's total liability for any claim arising out of or related to these Terms or the service shall not exceed the total fees you paid to MyClaudia in the 3 months preceding the claim.

MyClaudia is not liable for any indirect, incidental, consequential, or punitive damages, including lost profits, lost bookings, or reputational harm, even if we have been advised of the possibility of such damages.

The AI receptionist is a software tool and may occasionally produce incorrect, incomplete, or contextually inappropriate responses. You are responsible for reviewing how the AI interacts with your clients and for maintaining appropriate human oversight of your salon's communication.

9. Indemnification

You agree to indemnify and hold MyClaudia, its directors, employees, and partners harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your infringement of any third-party rights, including your obligations under data protection law toward your clients.

10. Term and Termination

These Terms remain in effect for the duration of your subscription. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period. We may suspend or terminate your account immediately for material breach of these Terms, including non-payment or violation of Section 4 (Acceptable Use). Upon termination, your right to access the platform ceases immediately.

11. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which MyClaudia Ltd is incorporated, without regard to conflict of law provisions. Any disputes arising under these Terms shall first be attempted to be resolved informally by contacting legal@myclaudia.ai. If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the applicable courts.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the service after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must cancel your subscription before the effective date.
